Terms of Service

These Terms of Service ("Terms") set forth the rights and obligations between the operator ("Operator") of the application "Pofio" ("App") and users of the App.

By using the App, you agree to be bound by these Terms.

Article 1 (Scope)

1. These Terms apply to all matters relating to the use of the App between the Operator and the User.

2. Any rules, guidelines, or other provisions published by the Operator within the App, on websites, or through other media shall form part of these Terms.

3. In the event of any conflict, these Terms shall prevail.

Article 2 (Definitions)

1. "User" means any individual who uses the App in agreement with these Terms.

2. "User Agreement" means the agreement formed between the Operator and the User for the use of the App under these Terms.

3. "User Data" means all information entered, transmitted, stored, or generated by the User within the App.

4. "Paid Features" means features provided in exchange for payment.

Article 3 (Registration)

1. The App includes features available without registration and features that require registration.

2. Users shall provide accurate and up-to-date registration information.

3. The Operator may refuse, suspend, or delete a registration without prior notice if the information is found to be false.

4. The Operator is under no obligation to disclose reasons for registration decisions.

Article 4 (Fees and Billing)

1. The App may offer both free and paid features.

2. Details, pricing, payment methods, and cancellation terms for paid features are displayed within the App.

3. Payments may be processed through app store platforms, and Users agree to comply with the applicable platform terms.

4. Except as required by law, the Operator has no obligation to refund fees already paid.

5. The Operator may change paid feature content or pricing without prior notice.

Article 5 (Advertisements)

1. The Operator may display advertisements within the App.

2. The Operator assumes no responsibility for the content of advertisements or the services they link to.

Article 6 (User Data)

1. Users are responsible for managing their own User Data.

2. The Operator makes no guarantees regarding the storage, backup, or integrity of User Data.

3. The Operator is not liable for any damage arising from loss of User Data.

4. The Operator may use User Data within the scope of the Privacy Policy and these Terms.

Article 7 (AI Analysis Features)

1. The App may offer optional features such as AI-generated analysis reports ("AI Features").

2. When you use AI Features, User Data may be transmitted to and processed on servers managed by the Operator and on third-party generative AI services contracted by the Operator. The scope of data sent, disclosure to third parties, and retention are described in the Privacy Policy.

3. AI Features are subject to usage limits. Currently, the AI report may be generated only once per month for the current month, and cannot be regenerated once created. The Operator may change usage limits, eligible periods, or other conditions without prior notice.

4. Text produced by AI Features is auto-generated reference information only. The Operator does not warrant its accuracy, currency, or completeness. It does not constitute investment, tax, legal, or other professional advice, nor does it recommend any particular action or decision.

5. You are solely responsible for interpreting and acting on AI Feature outputs. The Operator assumes no liability for decisions or damage arising from their use.

6. The Operator may change, suspend, or discontinue AI Features or their terms of use at any time.

Article 8 (Prohibited Conduct)
Users shall not engage in the following when using the App:

1. Acts that violate laws or public order and morals

2. Acts that interfere with the operation of the App or the Operator

3. Unauthorized access, analysis, reverse engineering, or modification

4. Entering false or misleading information

5. Acts that infringe on the intellectual property, privacy, or other rights of the Operator or third parties

6. Any other acts deemed inappropriate by the Operator

The Operator may suspend use or delete data without prior notice if prohibited conduct is identified.

Article 9 (Intellectual Property)

1. All intellectual property rights relating to the App and its content belong to the Operator or their rightful owners.

2. Users are granted only a non-exclusive, non-transferable right to use the App in accordance with these Terms.

Article 10 (Service Changes and Termination)

1. The Operator may change, suspend, or terminate the App without prior notice.

2. The Operator is not liable for any damage arising from such changes.

Article 11 (Disclaimer)

1. The App does not provide professional advice.

2. The Operator makes no warranties regarding the accuracy of any content.

3. Even if the Operator is found liable, compensation shall not exceed the total fees paid by the User in the relevant month (zero for free usage).

Article 12 (Indemnification)
Users shall indemnify the Operator for any damage caused by a violation of these Terms.

Article 13 (Amendments)
The Operator may amend these Terms at any time. Amendments take effect when published within the App.

Article 14 (Governing Law and Jurisdiction)

1. These Terms are governed by the laws of Japan.

2. Any disputes relating to the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Operator's location.
